Code of Civil Procedure, 1908–Order 14, Rule 1–Dismissal of suit by closing the evidence of plaintiff and without framing the issues–Plaintiff failed to appear before the Trial Court despite numerous opportunties–Although issues were not framed but on the basis of pleadings of the parties, Trial Court rightly framed point for determination–There was no illegality in not framing the issues–First Appellate Court also rightly dismissed the appeal–Interference declined.
