Penal Code, 1860–Sec. 354 [Corresponding Sec. 74 of BNS, 2023]–Charge framed for the offence–Justification–FIR was lodged after an inordinate delay of nine months–Petitioner has been exonerated by the Internal complaint committee constituted under the provisions of POSH Act–The committee found that the allegations were baseless and motivated by malice–Investigation Officer failed to incorporate or consider the report of commitee–Absence of any previous complaint of physical misconduct before the committee–Criminal proceedings are liable to be quashed.
