Stamp Act, 1899–Secs. 33 & 35–Rajasthan Stamp Act, 1998–Secs. 37 & 39–Application for impounding the agreements of sale–Rejection of–Suit for specific performance of sale agreement–If the documents were found to be deficiently stamped, these could be impounded and sent for requisite stamp duty and penalty–Admissibility and inadmissibility of documents was required to be decided by the trial Court first–Trial Court did not do so and proceeded ahead–Impugned order set aside and matter remanded back to decide the application in accordance with the law.
