Permanent Injunction–Simpliciter suit for–Dismissal of–Plaintiff failed to produce the evidence to prove his possession –Rather, the defendant nos. 1 & 2 were found in the possession–He admitted in the plaint that defendant no. 3 executed the sale deed of certain part of Guwadi in favour of defendant nos. 1 & 2 but nowhere claimed any relief of declaration challenging the sale deed qua his right, title and interest–Document produced by him is an agreement, and it could not be proved as an exchange–Further, the same is unregistered, and it was not executed by both parties–Furthermore, he has not sought the declaration of ownership and possession on the basis of agreement–First Appellate Court recorded the findings that the agreement is a suspicious document–Held, suit was rightly dismissed.
