Hindu Marriage Act, 1955–Sec. 13–Denial from granting the decree of divorce–Allegations by the appellant-wife that the respondent-husband is incompetent to make physical relations, he was in habit of taking liquor, and threatened to kill her–In the case lodged by her for the offences u/ss. 498-A & 406, police submitted the charge-sheet–Respondent admitted in cross-examination that he had taken the liquor for many times–Both have been living separately more than ten years–No chance of their re-union–Decree of divorce deserves to be granted.
