Penal Code, 1860–Secs. 406 & 420–Prayer for quashing the FIR–Allegation up to effect that the petitioner executed the sell agreement of shop in which it was mentioned that the shop was totally free from all encumbrances, no loan, etc. was existing thereupon–Investigation Officer collected the positive evidence to show that he had taken the loan by mortgaging the shop in question–No case is made out for quashing the FIR as the necessary ingredients of cognizable offence are disclosed and it would not be prudent to hold that the case involves a dispute purely of civil nature.
