Specific Relief Act, 1963–Sec. 6(3)–Code of Civil Procedure, 1908–Order 9, Rule 13 & Sec. 96–Decree of suit u/s. 9 of the Specific Relief Act–Appeal against–Maintainability–Judgment was passed on 13.03.2014 and the appeal was disposed of with the specific observation that the appellants should go for remedy of the application under Order 9, Rule 13–Application preferred by the appellants under Order 9, Rule 13 was dismissed and the order passed therein attained finality–Thereafter, the instant regular appeal was filed–General Principal that even if the application under Order 9, Rule 13 has been rejected, the party would not be precluded from preferring a regular appeal, would not be applicable in the instant case in view of bar u/s. 6(3)–Appeal is not maintainable.
