Negotiable Instruments Act, 1881–Sec. 139–Presumption under–When does arise ?–Once the issuance of the cheque is admitted/established, the presumption would arise u/s. 139 in favour of the holder of cheque–The burden lies upon the accused to rebut the presumption by adducing the evidence–Until the accused discharges his burden, the presumption will continue to remain.
