Code of Criminal Procedure, 1973–Sec. 457–Essential Commodities Act, 1957–Sec. 3/7–While allowing for releasing the vehicle, Court below refused to hand-over the product loaded therein–Police seized the produce suspecting that it was a mixed/spurious diesel constituting the offence u/ss. 3/7 of the E.C. Act–Keeping the petroleum product in the custody of respondents would be dangerous as also it would be violative to the rights of the petitioner–No fruitful purpose would be served in keeping the product till the conclusion of investigation / trial–Directed for release of same subject to certain conditions.
