Transfer of Property Act, 1882–Secs. 10 & 11–Evidence Act, 1872–Secs. 91 & 92–Code of Civil Procedure, 1908–Order 7, Rule 11–Suit for cancellation of sale deed which was executed in the year 1978–Ground that the conditions of sale deed were violated–Acceptability–Sale deed does not contain any such condition that the purchaser shall use the land in question for public purpose–Oral evidence contrary to documentary evidence is not admissible–Such oral condition is void in view of the provisions of Secs. 10 & 11 of T.P. Act–Held, suit is liable to be dismissed by invoking the provisions of Order 7, Rule 11.
