Negotiable Instruments Act, 1881–Secs. 138 & 147–Penal Code, 1860–406, 420 & 120-B–Compound of case–Appellant has paid all the due amount and additional amount of Rs. ten lakh as compensation–Earlier, the parties entered into the settlement before the Lok Adalat but it was frustrated on the ground that the appellant could not pay the complainant on the deadlines stipulated in the settlement–Now, the complainant is not willing for settlement–Even in the absence of consent, Court can close the criminal proceedings against on accused in case of Section 138 of NI Act if accused has compensated the complainant–Some peculiar facts of the case that the appellant has already been in jail for more than one year and he has compensated the complainant–If the criminal appeals are allowed to be continued, then it would defeat all the efforts of this Court–Further, in the criminal case, there nothing on record to show that the appellant had any ill intention of cheating or defrauding the complainant from the very inception–All the criminal proceedings are liable to be quashed.
