Code of Civil Procedure, 1908–Order 21, Rule 90–Applicability–Provision deals with the cases for setting aside the auction sale on the ground of material irregularity or fraud in publishing or conducting such sale when made under the order of Executing Court for the purpose of realizing the fruits of decree–In the instant case, the sale deeds were executed in favour of plaintiff-decree holder and other persons named by him in the process of execution of decree of specific performance–Impugned registration of sale deed is not covered by the scope of Order 21, Rule 90–Applications under Order 21, Rule 90 were misconceived and misdirected.
