Rajasthan Municipal Act, 2009–Land of khatedars was given for construction of building for public health care centre subject to exchange of the cost or abadi land–Thereafter, the Municipal Board declined to give abadi land to the petitioners on the pretext that there is a news item published in the newspapers regarding surrender of the land by the petitioner on free of cost–Justification–Respondents have duly raised the construction upon the land in dispute and are also utilizing the infrastructure raised thereupon–Petitioners specifically stated in the reply dated 30.07.2008 that the land is surrendered only on the condition that the abadi land be given to them in exchange–Held, impugned order of denial is liable to be quashed and set aside.
