Penal Code, 1860–Secs. 498A, 323, 504 & 506–Code of Criminal Procedure, 1973–Sec. 154–Cognizance for the offence on the protest petition–Sustainability–FIR was lodged after the delay of nine months–Police filed the negative final report with the conclusion that the complainant resided in the matrimonial home only for fifteen days–This closure report was filed on 06.09.2014 and it was challenged by the complainant in the year 2019–Trial Court accepted it without going into the questions of delay and lapse–Allegations are also extremely generalized in nature–Held, High Court ought to have exercised the powers u/s. 482 –Proceedings are liable to be quashed.
