Code of Civil Procedure, 1908–Order 2, Rule 2–Applicability of provision–On the earlier occasion, the evidence of the petitioner was closed by the trial Court, however, this Court allowed him to lead the evidence on the ensuing date of hearing subject to the payment of cost–Two other witnesses viz. the Commissioner of Municipal Council and Sub-Registrar did not turn up–Petitioner filed the application for summoning them–Rejected with the view that only one last opportunity was granted by the High Court–Held, he cannot claim any further chance of evidence–Application was barred by the provisions of Order 2, Rule 2 and it was rightly dismissed.
