Wakf Act, 1995–Secs. 6 & 7–Code of Civil Procedure, 1908–Order 7, Rule 10/11(d) & Secs. 21 & 151–Contention of petitioner-defendant that the jurisdiction of Tribunal is limited only to the disputes covered u/ss. 6 & 7–Declined to accept–As per Secs. 6 & 7, the disputes mentioned therein could only be decided by the Tribunal which shall be final–However, Sec. 83 of the Act defines the jurisdiction of Wakf Tribunal which permits entertainment of the instant suit by the Tribunal–Application was rightly rejected.
