Code of Civil Procedure, 1908–Sec. 100–Rent Control & Eviction–In the second appeal, the High Court concluded that the landlord-tenant relations cannot be sustained and reversed the concurrent findings of the Courts below–Justification–Under the jurisdiction u/s. 100, High Court is not to disturb the findings of facts–Questions as framed by the High Court do not meet the criteria to be substantial questions of law–Conclusion of Trial Court on the issue of landlord-tenant relations does not involve any interpretation of the law and findings pertain to be proved on the basis of surrounding circumstances–First Appellate Court also recorded the findings accordingly after considering the evidence–Defendant has been unable to prove his ownership of the subject property by way of adverse possession–Impugned order passed by the High Court is liable to be set aside.
