Rajasthan Rent Control Act, 2001–Secs. 18 & 9–Code of Civil Procedure, 1908–Sec. 151–Prayer to dismiss the eviction petition on the ground that the landlords prayed also for dispossession from the encroachment, and they were required to file a separate suit for this purpose–Dismissal of application–Plea cannot be accepted as the provisions of Sec. 21 provides the same procedure and powers of the Tribunal for every case under the Act, be it under Chapter II & III or under Sec. 18 of the Act not covered under these Chapters–Application was rightly dismissed.
