Code of Civil Procedure, 1908–Order 37–Recovery of money–Suit for–Dismissal of–Amount of Rs. 4,000/- was paid by the appellant-plaintiff as an agricultural loan–As per agreed terms, the interest was payable at the rate of 9% per annum–As per Ex.1, the plaintiff-bank itself had exempted the persons who obtained the agricultural loan and their amount was less than Rs. 10,000/- –Due amount was Rs. 5,520/- –Held, the plaintiff-bank was not entitled for recovery of same in view of Ex. A-1–No interference is required in the impugned judgment of the trial Court.
