Negotiable Instruments Act, 1881–Sec. 138–Dismissal of complaint in default–Case was listed on 17.05.2019 but the counsel of the complainant could not appear due to a wrong assumption that the other cases were listed on this date and he could not notice the different next dates–Complaint is restored and the Trial Court is directed to proceed with the trial of the case.
