Penal Code, 1860–Secs. 498A, 504, 506 & 323–High Court quashed the criminal proceedings against all the accused on the ground that the arrest of respondent nos. 3 & 4 was without following the due process of law, allegations made in the complaint are omnibus, and Court at Jamshedpur was not having jurisdiction–As per averments made in the complaint, prima facie case is made out against the respondent nos. 3, 4 & 8–High Court entered into the merits of allegations which was not permissible–Allegations against respondent nos. 4 to 7 are not only omnibus but also without any specific allegation of overt act–After having been driven from the matrimonial home, complainant is residing at her parental home at Jamshedpur–Therefore, the Court at Jamshedpur was having the jurisdiction–Held, order of quashing the proceedings against the respondent nos. 3, 4 & 8 deserves to be set aside.
