Rajasthan Pre-emption Act, 1966–Secs. 6, 8 & 9–Transfer of Property Act, 1882–Sec. 44–Code of Civil Procedure, 1908–Order 39, Rules 1 & 2–Order of status quo–Appreciation of–Suit for claim of rights of pre-emption–Respondent no. 1 having the 1/6 undivided share, executed the sale deed in favour of respondent no. 2–No notice was given as contemplated u/s. 9–Prima facie non-compliance of provisions of the Act of 1966–Further, the outsider cannot be permitted to continue in possession with the co-sharers of property as the property has not been divided–Held, respondent no. 2 will vacate the suit premises and appellants are directed to deposit the amount of Rs. sixteen lakh to show their bonafide right of pre-emption.
