Rajasthan Pre-emption Act, 1966–Sec. 6–Right of pre-emption–Availability & establishment–Right of pre-emption is a weak right and must be clearly established through strict pleadings as well as cogent evidence–The burden lies squarely on the person asserting the right to demonstrate both the legal basis for such a claim, whether statutory, customary or contractual and the factual pre-conditions required to exercise such a right.
