Prevention of Corruption Act, 1947–Sec. 5(1)(d)(2)–Penal Code, 1860–Sec. 161–Conviction–Sustainability–Prosecution proved the recovery beyond the reasonable doubt but there is neither any transcript nor any tape recording/telephonic conversation/phone records nor any motbir witness nor anything which could establish the element of demand–Element of demand is clear absent and it is a fit case for acquittal of accused.
