Indian Telegraph Act, 1885–Sec. 16(1)–Scope–District Magistrate alone is competent to pass an order granting permission to the petitioner to exercise powers u/s. 16 of the Act in removing the resistance or obstruction–In the present case, direction was given to SDM to exercise the powers which is contrary to the provisions–Held, District Collector is directed to pass a fresh order after giving the reasonable opportunity to the persons resisting or obstructing in terms of the mandate contained u/s. 16(1) of the Act.
