Sec. 151–Application for striking out the unnecessary pleadings–Rejection–Appreciation–Suit was under the provisions of Sec. 106 T.P. Act, however, it does not preclude the respondents from making any pleadings in their plaint–Further, the respondents did not take any objection in the written statement and denied them–Issues have been framed by the pleading which are sought to be objected–Held, application was rightly dismissed–However, petitioner are liberty to oppose these pleadings at the time of adjudication of issues.
