Hindu Marriage Act, 1955–Sec. 13–Application for stay of the proceedings of divorce–Dismissal of–Submission of applicant-wife that the respondent-husband is defaulting in making the payment of interim maintenance–Order of maintenance may be enforced like a decree of Civil Court and striking off the defence of the respondent should be last resort–On account of non-compliance of the order of interim maintenance u/s. 125 Cr.P.C., it is open for the wife to apply before the Family Court to get defence of the husband struck off–No reason is found to interfere and substitute the own discretion or opinion of this Court.
