Rajasthan Minor Minerals Concession Rules, 1986–Rule 18(21)–Case of sub-letting of lease through power of attorney–Termination of lease with imposing the penalty–Power of attorney executed in favour of T was not cancelled within fifteen days of notice–Rule 18(21) was operative in the facts of case–However, clause 4(22) of lease by which the penalty was provided, was wrongly invoked because the Rule and Clause provide for alternative penalty–If the lease has been terminated, then penalty cannot be imposed–Order of imposition of penalty is set aside.
