Penal Code, 1860–Secs. 302 & 392 r/w. 34–Conviction–Sustainability–Case of circumstantial evidence–Prosecution case is based on two circumstances–Recovery of mobile phone which was allegedly used for making the demand of ransom–This mobile number was not subscribed by the deceased but it was subscribed by S–Neither any link between these two persons was established nor the bill in name of deceased was produced–Further, the theory that the weapon was snatched by the accused was also not sufficiently established–Identification parade was not held and if it was held, no material on this behalf was produced–Many missing links in prosecution case–Appellant is entitled to be acquitted.
