Indian Succession Act, 1925–Sec. 63–Code of Civil Procedure, 1908–Order 39, Rules 1 & 2–Appellant challenged the validity of testamentary documents Wills, executed in favour of sole respondent–He denied his signatures and thumb impressions on the documents and alleged that these are forged and fabricated–He sought the declaration of Wills as null and void on various grounds–It would be appropriate to apply the principle of lis pendens and direct the respondent for not to alienate the properties in question during the pendency of suit–Directed accordingly.
