1988–Sec. 173–Appeal by Insurance Company–Plea of fake driving licence–No such plea was taken before the Tribunal–Insurance Company failed to prove the fact that the owner of vehicle permitted the driver knowingly that the licence was fake–Even if the licence is proved fake at the appellate stage, Insurance Company cannot be escaped from the liability–Application, as well as the appeal, is liable to be dismissed.
