Code of Civil Procedure, 1908–Sec. 96–Rajasthan High Court Ordinance, 1950–Sec. 50–Whether a person who is not a party to the proceedings giving rise to the order sought to be challenged in appeal, can be permitted to file an appeal with the leave of Court ?–Held, yes, if he is aggrieved by the order passed in the suit/petition, with the leave of Court, if he satisfies that he is an ‘aggrieved person’ or bound by the order or when order is prejudicial to his interest–In the instant case, the proposed appellants were permitted to interfere in the writ petition–They are the residents of a village where the pasture land is situated and it is to be proceeded to be entered in favour of writ petitioners–Appellants would be interested in ensuring that the land is for the benefit of all for grazing the cattle–It is the common interest of villagers–Leave to appeal deserves to be granted.
