Code of Criminal Procedure, 1973–Secs. 203, 204 & 209–Case which is triable exclusively by Sessions Court–What is to be seen by Magistrate?–Held, Magistrate is only to see whether on a perusal of the evidence there is sufficient ground for proceeding against the accused–At this stage, Magistrate is not required to weigh the evidence meticulously as if he was the trial Court nor he is required to scrutinise the evidence by the same standard by which the Sessions Court scrutinizes the evidence to decide whether to frame or not to frame charges under Sec. 227/228.
