Rajasthan Co-operative Societies Act, 2001–Secs. 28(10) & 58–Pre-election disqualification–Removal from the post on the ground of complaint–Permissibility–Case of more than two children after the cut-off-date–In the absence of any objection at the stage of submitting the nominations, the Election Officer treated the petitioner as eligible to contest the election–Dispute is under Sec. 28(10) of the Act, and it is a pre-election dispute, therefore, the remedy lies u/s. 58 of the Act–Remedy u/s. 28(13) would not be available in such cases–Impugned order is liable to be quashed and set aside–Respondent no. 6 can move an appropriate application for condonation of delay u/s. 59(1) of the Act, while mentioning the pendency of proceedings u/s. 28(3) of the Act and the pendency of this writ petition.
