Guardians & Wards Act, 1890–Sec. 9–Hindu Minority & Guardianship Act, 1956–Constitution of India, 1950–Art. 226–Habeas corpus petition in the cases of custody of minor–Maintainability–Ordinary remedy lies only under the Act of 1956 & 1890–Powers of High Court in granting the writ is qualified only in the cases where the detention of a minor by a person who is not entitled to his legal custody–Where it is proved that the detention of minor child by a parent or others was illegal or without authority, the writ of habeas corpus is maintainable–There are significant differences between the inquiry under the Guardians and Wards Act and the exercise of powers by the Writ Court which is summary in nature.
