Rajasthan Rent Control Act, 2001–Sec. 9–Code of Civil Procedure, 1908–Order 21, Rule 97–Decree of eviction in favour of respondent no. 5–During the pendency of execution proceedings, respondent L also filed a suit for eviction and entered into a compromise with the tenant M–M handed over the possession of shop to L–L tenanted the shop to present petitioner–Present Petitioner filed the application under Order 1, Rule 10 in the eviction proceedings filed by S which was rejected–Now the objection under Order 21, Rule 97 was filed by him in execution proceedings which came to be dismissed–Conduct of L and tenant M shows that the act was done with an oblique motive to deprive the respondent S of the fruits of decree–Rent note executed between L and present petitioner is nothing but a device or tactic to obstruct the execution of decree–Letting the shop by him to present petitioner on very next day of receiving the possession was hit by the provisions of Sec. 52 of TP Act–No error is found in the impugned order passed in execution.
