plaintiff was situated on public way and it was creating nuisance and obstruction to the public–Though the land was rented by Municipal Board, yet it was having no right to give permission to anybody to install a cabin in a piece of public way or chowk–Permission granted by it was void ab initio–Further, the tenancy was terminated by Municipal Board–Held, suit was rightly dismissed.
