Penal Code, 1860–Secs. 415, 420 & 120-B [ Corresponding Secs. 318(1), 318(4) & 61(2) of BNS, 2023 ]–FIR for the offence–Quashed by the High Court–Justification–Prima facie case that the respondent nos. 1 & 2 hatched criminal conspiracy and defrauded their aunts by creating a forged family tree and partition deed with a motive to gain all the monetory award for land in question bye-passing the appellant and her sisters–High Court erroneously relied upon the statement of sub-registrar–Sub-registrar has not put to cross-examination–It would be unwise to rely on unverified testimony of the sub-registrar to ascertain the genuineness of partition deed–Further, High Court could not find any justification to deny that the respondents misrepresented the family tree–Impunged order is liable to be set aside.
