Permanent Injunction–Suit for–Dismissal of–View of Trial Court that the plaintiffs failed to establish the title/interest of his alleged erstwhile owner in the subject property–Agreement of sale dated 13.12.1970 could not have created title of the plaintiff in the subject property–Plaintiff’s lawful possession was not proved–Further, the suit was not maintainable in view of the bar under Order 23, Rule 1(4)–Furthermore, the earlier suit was decided on the basis of compromise, therefore, the instant suit was not maintainable–Held, no merit is found in the second appeal.
