Code of Civil Procedure, 1908–Sec. 100–Objection in second appeal that the suit was filed by three plaintiff’s whereas the plaintiff no. 1 produced the power of attorney of other plaintiff’s after the date of filing suit–Reason for filing the power of attorney has been mentioned in para no. 2 of plaint which remained unrebutted and undisputed–Further, the objection was not taken in suit proceedings and no issue was framed as regard to this–Such cannot be allowed to be entertained in view of embargo contained under Order 41, Rule 2.
