Prevention of Corruption Act, 1988–Sec. 7–Conviction–Sustainability–Trap was planned and conducted based on the complaint, but it failed to yield–No money was accepted by the appellant nor any money was recovered from him–Complainant denied the bribery allegations and was declared hostile–No evidence of demand or acceptance of illegal gratification was presented–Presumption u/s. 20 cannot be invoked–There was no pending work of complainant with the appellant on the day of the complaint or trap–Appellant’s voice samples were neither sent to FSL nor identified by any officer–He is entitled to be acquitted.
