Code of Criminal Procedure, 1973–Secs. 177/178–Penal Code, 1860–Secs. 420, 120-B & 34–Prayer for quashing the FIR which has been lodged in the State of Arunachal Pradesh–Gauhati High Court has refused to quash the FIR on the ground that it discloses the commission of cognizable offence–Cause of action entirely arose within the State of Rajasthan–Transfer of money through the online transaction from Arunachal Pradesh to Jaipur Branch would not create the cause of action for the offence of cheating if the accused-persons would have acted as per the agreement between the parties–The real cause of action arose when the accused-persons refused to hand-over the property for which the money was paid–This incident took place in Jaipur–FIR is liable to be quashed.
