Hindu Minority & Guardianship Act, 1956–Sec. 8–Sale of the property of minors–Surviving minors on attainment of majority repudiated the transaction of sale executed by their father by entering into a fresh contract of sale of the property in question–It is an admitted fact that on the basis of the sale deed executed by their father, the purchaser or the subsequent purchaser have not entered into possession and the name of minors continued to appear in the revenue record–It cannot be said that the minors had the knowledge of the sale deed executed by their father–If they had avoided the sale deed executed by their father on attaining majority, it is sufficient repudiation of the said sale and it was not necessary for them to have instituted the suit for cancellation of such a sale.
