Prevention of Corruption Act, 1988–Sec. 19–While taking the cognizance, Trial Court cannot issue any specific positive direction for prosecution sanction as same is against the basic principles of law as related to prosecution sanction, including due application of mind–Court below has directed the Superintendent of Police, A.C.B. to obtain and submit the prosecution sanction–The Court has taken away the right of the concerned Competent Authority as regards their decision making power with respect of the issue to grant the prosecution sanction–Impugned order is against the basic principles of law.
