Partition–Claim of–Sustainability–Findings of Trial Court that the amount of Rs. 55,000/- was paid to respondent’s side–Nothing on record to say that it was paid to upkeep the HUF property or on some other account or to fulfill some other purpose–Admitted position that the respondents or their ancestors were never living in the Kamla Nagar property–It was disclosed by ACK in his Wealth Tax Return of the Year 1964-1967 that the value of property was around Rs. 38,000/- –Amount of Rs. 55,000/- having been paid does not indicate that the property was undervalued–Appellants having enjoyed possession right from the time, the property was purchased and even letting out the premises to tenants and collecting rent from the tenants without any claim raised at any point of time, would also support their claim–Held, appellants are the exclusive owners of this property.
