Rajasthan Panchayati Raj Act, 1994–Sec. 101(1)–Constitution of a new Municipality including the two villages of existing Gram Panchayat–Three villages remained in Panchayat and, therefore a new Gram Panchayat was reconstituted and named as Gram Panchayat Narsinghpura–Earlier members of Gram Panchayat continued to Function–However, after the lapse of the period of one year, the Administrator was appointed till the election of new Gram Panchayat–Justification–Such action is covered by the provisions of Sec. 101(1)(d) whereas the appointment of Administrator prescribed refers only to clause (a) & (c) of Sec. 101–Proviso to Sec. 101(2) would apply only in cases where the action has been taken in terms of Sec. 101(1)(a) & (c)–Impugned order is in excess of jurisdiction and dehors the provisions of Act of 1994–Quashed and set aside.
