Code of Civil Procedure, 1908–Order 14, Rule 2 & Order 7, Rule 11–Distinction between both provisions–While deciding an issue as a preliminary issue, the Court is required to see as to whether such issue is purely a question of law, which requires no evidence to be led, whereas while deciding the application under Order 7, Rule 11, the Court is required to consider
as to whether the plant deserves to be rejected while looking at the contents of the plaint.
