Rajasthan Forest Act, 1953–Sec. 52–Petitioner’s vehicle was declared as State property–Justification–While the alleged involvement of the vehicle in the incident has been recorded, there is no finding regarding the knowledge, consent or connivance of the registered owner–There is no satisfaction on the essential statutory ingredients necessary before declaring the vehicle as State property–Petitioners defence, including reference to the Gram Panchayat Work Order and his absence from the site has been noticed but not analysed–Vehicle has earlier been released by the Judicial Magistrate on suprdginama–Impugned order is liable to be set aside.
