Code of Civil Procedure, 1908–Order 39, Rules 1 & 2–Specific Relief Act, 1963–Sec. 12–Rejection of application–Justification–Case of the plaintiff that the agreement of sale was executed and amount of Rs. two lakh was handed over to the defendants out of the total consideration Rs. five lakh–Defendants raised the objection that no such agreement was executed and in the same breath they raised the objection that the agreement of sale is not sufficiently stamped–If the third party rights are created, it would result in multiplicity and complicity of proceedings–Respondents are directed for not to alienate the land.
