Penal Code, 1860–Secs. 324 & 326–Conviction–Findings of–Under challenge–Three injuries are reflected to have been inflicted on the person of injured by a sharp blade–This assertion was confirmed by the doctor–PW 1 & PW 2 are the eye-witnesses of incident and their statements are in conformity with the parcha bayan–Plea of the petitioner that they were not the eye-witnesses, cannot be countenanced–Parcha bayan was prepared immediately after the occurrence and medical inspection was carried–Therefore, the statements of DW 1 are illusionary in regard to allegation of injured being intoxicated–Held, no case is made out for interference–Further held, the argument of the petitioner in regard to his old age also cannot be countenanced on account of the severity and gravity of injuries.
